Terms & Conditions
Prior to the participation in Gunijaan Bandish Rashtriya Pratiyogita (hereinafter referred to as ‘the Contest’ it is advisable to all the participants to read the following terms & conditions and ensure that you are completely aware of them. These terms and conditions are unconditionally and irrevocably binding to all participants.
1. General
1. The terms and conditions are applied to the Contest promoted by GRACE Foundation 103, Swastik Chambers, S.G. Barve Marg, Chembur, 400071 (also referred to as organiser)
2. GRACE Foundation reserves the right to make changes to the schedule and format of the event with prior notice through the website login section. Participants are required to check their login accounts regularly for update.
3. Any changes to the terms and conditions, or cancellation of the Contest, will be posted on Gunijaan Bandish Rashtriya Pratiyogita website at www.gunijaanbandish.in (hereinafter referred to as ‘the website’ ). It is the responsibility of participants to keep themselves informed as to any changes to the terms and conditions.
4. GRACE Foundation reserves the right to cancel or amend all or any part of the Contest and/or the rules without prior notice for any event that is outside of GRACE Foundation’s reasonable control or Force Majeure.
5. Force Majeure: Force Majeure events shall include act of god, public enemy, epidemics, revolt, strikes, riot, fire, flood, war, typhoon and acts and Regulations of the government, unusually severe weather, typhoons, earthquakes, or volcanic eruptions, change of policies by Central/State Government/ Municipal/local Authorities, civil disturbance and disruptions due to political/ industrial agitation, etc. of the participant or any other event, obstacles, reason or circumstances beyond the control of GRACE Foundation or the participant. Any party asserting Force Majeure as an excuse shall have the burden of proving that reasonable steps were taken (under the circumstances) to minimize delay or damages caused by foreseeable events, that all non-excused obligations were substantially fulfilled, and that the other party was timely notified of the likelihood or actual occurrence which would justify such an assertion, so that other prudent precautions could be contemplated.
6. Each participant undertakes the Contest at their own risk and agrees to indemnify GRACE Foundation and its employees against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors fees) and any claim arising from the participant’s own actions in any way in connection with the Contest, the prize or a breach of the participant’s obligations as stated in the website.
7. The Contest is subject to and construed in accordance with the laws of India and the courts of Mumbai shall have exclusive jurisdiction for any matters arising out of or in relation to the Contest.
8. Any disputes, differences and/or any other matters in relation to and arising out of the Contest and, or pertaining to these terms and conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The venue of arbitration shall be Mumbai. The Rules of Indian Council of Arbitration(“Rules”) shall apply to the arbitration proceedings and the arbitration shall be conducted by a sole arbitrator to be appointed as per the Rules.
2. Contest and Prize
‘Winner’ refers to any/all of the 3 winners in both categories selected in the finals. ‘Prize’ refers to the prizes to be awarded to the selected winners of the Contest as defined in the section ‘Prizes & Recognition’.
1. The Contest shall run strictly in accordance with the Contest details as stated in the website. Schedules are subject to change, with advance intimation through the website and login accounts of registered participants.
2. Eligibility Criteria is strictly as per what is listed on the website. Participants that do not meet the criteria will be disqualified.
3. All participants shall be responsible for ensuring that their entry and/or acceptance of the prize (as defined under ‘Prizes & Recognition’) does not contravene any local laws or regulations. The Contest shall be void where prohibited or restricted by law.
4. All personal details submitted at the time of participation must be accurate and complete and are subject to further proof upon request by GRACE Foundation. GRACE Foundation reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entry not submitted in accordance with these terms and conditions or instructions on the website, or which tampers with the entry process.
5. Incomplete, unclear (both audio and /or visually), indecipherable, illogical and incorrect entries or any entry which violates the terms and conditions and instructions , will automatically be disqualified. Entries received after the closing date of the Contest will be disqualified.
6. GRACE Foundation shall not be responsible for technical errors in telecommunication networks, internet access or otherwise preventing entry to the Contest.
7. GRACE Foundation reserves the right to discount multiple entries from the same IP address or the same user.
8. GRACE Foundation reserves the right to forfeit a participant’s place in the Contest or the Prize (without liability or compensation) if, in its opinion, the participant may expose himself/herself to risk of illness or injury or the cancellation, disruption, or curtailment of the Contest.
9. GRACE Foundation reserves the right to select an alternative Winner at any time, where it has reasonable grounds for believing that the initially selected Winner has contravened any of the mentioned terms and conditions. Any alternative Winner will be selected applying the same criteria as that used to select the original Winner.
10. Participation in the Contest shall constitute consent on the participant’s part, to allow to use the entry, name, images, video footage, voices, GRACE Foundation for editorial, advertising, promotional, marketing and/or other purposes, without further compensation, in any media for an unlimited period of time, except where prohibited by law. This applies to all rounds of the Contest.
11. GRACE Foundation is not liable in any way for any costs, expenses, damages, liability or injury arising while/during the participant travelling to the specified city and/or during their stay.
12. Cost of travel to Pune city and stay in Pune city for the duration of all Off-line rounds (including the Finale) is to be borne by the participant. Participants eliminated at any stage of the Contest are free to return home right after the completion of the round (i.e. after announcement of selected participants of the said round).
13. The participant fee is non-refundable under any circumstance.
14. Direct family members and relatives of the Contest organisers cannot participate in the Contest.
15. The decision of the judges at every stage of the Contest are final and binding.
